And that trust is enormous. Nonprofits are given responsibility for our most vulnerable populations, for people who may not have the sophistication to understand their options in services or treatments. 66 This deep reservoir of trust extends to almost all realms of nonprofits’ activity, except for involvement in public policy. In the case of advocacy, the federal government has a policy of restrictive regulation. One thing that has not devolved down to nonprofits is the right to represent those that they serve.

For many forms of lobbying, policymakers have to open the door before the group can commence its petitioning. Are those behind the door obligated to open it to all groups that seek an audience? Can those who get an audience bring gifts with them, like campaign contributions? If so, how much? Obviously, there have to be some rules. In practical terms, there are at least four underlying rationales for government regulation of interest groups: integrity and accountability. If government did not regulate the participation of interest groups, the wealthiest organizations would have such undue influence that democracy would be threatened if not extinguished.

Even so, an extensive array of campaign finance restrictions and ethics standards is in place on the federal level. Each state nonprofits as interest groups 37 has its own restrictions as well. Critics mock these rules, seeing them as something like the little Dutch boy with his finger in the dike: no sooner do you stop one form of interest group money from getting to the politicians than another source sprouts. For the less cynical, these regulatory steps are seen as crucial to the integrity of the political system, and for that reason these restrictions on the First Amendment right to lobby are easily justified.
